Terms of Service

1. Acceptance of Terms

By accessing or using PropTrack — including our website at proptrack.app, web application at app.proptrack.app, and mobile applications — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

You must be at least 18 years old to use PropTrack. By using the service, you represent that you meet this age requirement.

2. Service Description

PropTrack is a property maintenance tracking platform designed for independent landlords managing small rental portfolios. The service allows landlords and tenants to:

• Submit and track maintenance requests
• Communicate about property issues through built-in messaging
• Log and categorize property expenses
• Manage tenant information and unit details

PropTrack is a communication and tracking tool. We are not a property management company and do not provide legal, financial, or maintenance services.

3. Accounts & Registration

To use PropTrack, you must create an account with a valid email address and password. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

Landlord accounts are created via direct signup. Tenant accounts are created through an invite code provided by their landlord. Each account is associated with a single role (landlord or tenant).

4. Plans & Billing

PropTrack offers the following subscription tiers:

• Starter (Free): 1 unit
• Essential ($9/mo): Up to 3 units
• Pro ($19/mo): Up to 10 units
• Business ($49/mo): Up to 25 units

Paid plans are billed monthly. You may cancel at any time, and your access will continue through the end of your current billing period. We do not offer refunds for partial months.

5. SMS & Text Messaging

PropTrack offers optional SMS notifications for maintenance request updates and property alerts. By opting in to SMS notifications, you agree to the following:

• Consent is voluntary. You are not required to opt in to SMS to use PropTrack. SMS consent is collected separately from account creation through an explicit opt-in checkbox.
• Message types: You will receive informational text messages about maintenance requests, property updates, and service notifications. We do not send marketing or promotional messages via SMS.
• Frequency: Message frequency varies based on your property activity.
• Costs: Standard message and data rates from your carrier may apply.
• Opt-out: You may opt out at any time by replying STOP to any message, updating your account settings, or contacting us at support@proptrack.app. After opting out, you will receive one confirmation message and no further texts.
• Help: Reply HELP to any message for assistance, or contact support@proptrack.app.
• No sharing: We do not sell, rent, or share your phone number or SMS consent with third parties for their marketing purposes.

6. Acceptable Use

You agree not to use PropTrack to:

• Violate any applicable law or regulation
• Harass, threaten, or intimidate other users
• Upload malicious content, malware, or spam
• Impersonate another person or entity
• Attempt to access another user's account or data
• Use the platform for any purpose other than property management

We reserve the right to suspend or terminate accounts that violate these guidelines.

7. Intellectual Property

PropTrack and its original content, features, and functionality are owned by PropTrack LLC and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of any data you enter into PropTrack (property details, maintenance requests, messages, expenses). By using the service, you grant us a limited license to store, process, and display your data solely to provide and improve the service.

8. Termination

You may close your account at any time by contacting support@proptrack.app. Upon account deletion:

• Your profile and all associated data will be permanently deleted within 30 days
• Messages may be retained for up to 90 days for dispute resolution before deletion
• Any active subscription will be canceled

We may suspend or terminate your account if you violate these Terms, with or without prior notice.

9. Disclaimers & Limitations

PropTrack is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, PropTrack LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, revenue, or business opportunities.

Our total liability for any claim arising from these Terms or your use of PropTrack shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via email or a prominent notice in the app at least 30 days before the changes take effect. Your continued use of PropTrack after the effective date constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved in the state or federal courts located in Delaware.
